Terms and Conditions

Welcome to B-Side Apparel (the "Site"), operated by B-Side Apparel ("we," "us," or "our"). These Terms and Conditions ("Terms") govern your use of the Site and any purchase you make from us. By accessing the Site or placing an order, you agree to be bound by these Terms.

1. About Us

B-Side Apparel designs and sells clothing, including through collaborations with partner businesses. We are based in the United Kingdom. Our registered address is 11 Bridge Street, Bury, Lancashire, England, BL0 9AB, and you can contact us at INFO@bside-apparel.com.

2. Products and Partner Collaborations

Some products on the Site are created in collaboration with partner businesses. When a partner's designs sell, we share the resulting revenue with that partner. We are the seller of record for all products on the Site, regardless of which partner's designs they feature, and these Terms apply to all purchases.

We reserve the right to add, remove, or discontinue products, including partner collections, at any time without notice.

3. Orders and Acceptance

  • Placing an order through the Site constitutes an offer to purchase. We reserve the right to accept or decline any order for any reason, including suspected fraud, pricing errors, or stock unavailability.

  • You will receive an order confirmation once your order is placed. This confirms we have received your order, not that we have accepted it.

  • A contract between you and us is formed only when we dispatch your order or send you a shipping confirmation.

4. Pricing and Payment

  • All prices are listed in GBP (£) and are inclusive of VAT where applicable, as indicated at checkout.

  • Payment is processed securely through Squarespace Payments at the time of order. We do not store your full card details.

  • We reserve the right to correct pricing errors, even after an order has been placed, and will contact you if this affects your order.

  • Discount codes are subject to the specific terms stated at the time they are issued, are not combinable unless stated otherwise, have no cash value, and may be withdrawn or amended at any time.

5. Order Fulfillment and Shipping

  • Orders are manufactured and fulfilled by our print-on-demand manufacturing partner. As a result, production and delivery times may vary by product and destination.

  • Our fulfilment partner typically aims to complete production within 3–15 business days depending on order size, with shipment arranged shortly after. Estimated delivery times shown at checkout are estimates only and not guaranteed.

  • Orders can generally only be cancelled and fully refunded before production has started. Once production has begun, cancellation may no longer be possible or may only be eligible for a partial refund.

  • We currently ship primarily within the UK but welcome orders from other countries. International orders may be subject to import duties, taxes, or customs fees, which are the responsibility of the customer and are not included in the item price or shipping cost.

  • Risk of loss and title for products pass to you upon delivery to the shipping carrier.

6. Returns, Refunds, and Cancellations

  • Because our products are manufactured to order by our fulfilment partner, general "change of mind" returns are not accepted for items that have been produced accurately to the design shown on the Site.

  • Damaged, defective, or misprinted items: contact us at INFO@bside-apparel.com within 7 days of delivery, including your order number and photos of the issue, and we will arrange a replacement or refund via our fulfilment partner.

  • Lost packages: claims must be submitted within 7 days of the estimated delivery date.

  • Beyond faulty items, a return or refund may still be requested within 180 days of delivery, but the following cannot be returned or refunded unless faulty or incorrectly produced: underwear, swimwear, socks, and similar items for hygiene reasons; sample items; items deliberately damaged after delivery; and items produced correctly according to the design shown but no longer wanted.

  • Approved returns must be unused, unworn, unwashed, and in original condition. Return shipping costs are the customer's responsibility; we do not offer freight-to-collect returns.

  • UK customers: Under the Consumer Contracts Regulations 2013, you may have a legal right to cancel certain orders within 14 days of receipt for a full refund, subject to exceptions (personalized or made-to-order items are often excluded, as ours are). Nothing in these Terms affects your statutory rights.

  • EU customers: Similar cancellation rights may apply under EU consumer protection law.

7. Product Descriptions

We try to ensure product descriptions, images, and pricing are accurate, but errors may occur. Colours may vary slightly depending on your device display. We do not guarantee that any product description is accurate, complete, or error-free.

8. Intellectual Property

All designs, logos, images, and content on the Site are owned by us or our partner businesses and are protected by copyright and trademark law. You may not reproduce, distribute, or use our designs or partner designs without prior written permission.

9. Acceptable Use

You agree not to:

  • Use the Site for any unlawful purpose

  • Attempt to gain unauthorized access to the Site or its systems

  • Use automated means (bots, scrapers) to access the Site without permission

  • Misuse discount codes, including sharing codes not intended for you or attempting to abuse promotional offers

We reserve the right to cancel orders or restrict access to the Site if we reasonably suspect misuse.

10. Limitation of Liability

To the fullest extent permitted by law:

  • We are not liable for any indirect, incidental, or consequential losses arising from your use of the Site or purchase of products.

  • Our total liability for any claim relating to your order is limited to the amount you paid for the relevant product.

  • Nothing in these Terms excludes or limits liability for death, personal injury caused by negligence, fraud, or any other liability that cannot be excluded by law.

11. Privacy

Our collection and use of your personal information is governed by our [Privacy Policy], which forms part of these Terms.

12. Governing Law

These Terms are governed by the laws of England and Wales. Any disputes arising from these Terms or your use of the Site will be subject to the exclusive jurisdiction of the courts of England and Wales, without prejudice to any mandatory consumer protections in your country of residence.

13. Changes to These Terms

We may update these Terms from time to time. Changes will be posted on this page with a revised "Last updated" date. Continued use of the Site after changes take effect constitutes acceptance of the updated Terms.
